1. Terms and conditions of sale

Tuxedo Srl., operating under the "Borgia Milano" or "Borgia Store" brand, with registered office at Via F.T. Marinetti 11/B 62012 Civitanova Marche (MC), Italy, hereinafter referred to as the "Seller", hereby provides the following general terms and conditions of sale (hereinafter the "Terms and Conditions") applicable to all orders placed through the borgiastore.it website. Each purchase is deemed concluded upon confirmation of the order by the Seller, who reserves the right to accept or reject any order at its sole discretion. These Terms and Conditions govern the contractual relationship between the Seller and the Customer, who becomes a party to the contract by expressly accepting these Terms and Conditions before completing the order.

2. Payment methods

The Customer can choose between the following payment methods, all managed in complete security using cryptographic protocols:

- Credit/debit card (Visa, MasterCard, American Express, Maestro)
- Apple Pay
- Google Pay
- Shop Pay
- Bank transfer

For payments by bank transfer, the order will be processed only after the payment has been credited to the Seller's bank account. Customers are invited to include the order number received via email in the reason for payment to expedite processing.

3. Shipping costs

Shipping costs vary based on the destination geographic area and follow the following structure:

Italy: Shipping € 7,00
Europe (UE): Shipping € 15,00
Countries outside the European Union: Shipping € 25,00

Preparation and delivery times may vary depending on the destination address and any customs procedures. Any customs duties and local taxes are the responsibility of the Customer (see section 5). The Seller cannot be held responsible for delays caused by customs controls or regulations in the importing country.

Delivery times in Italy are 1-3 business days from order confirmation. For international shipments, delivery times may vary and be longer depending on the destination country. Orders placed during special discount periods may experience delivery delays.

4. Exchanges and returns

The customer has the right to withdraw from the purchase within 14 days from the date of receipt of the products, in accordance with current legislation.

To exercise the right of withdrawal or request a return, the customer must use the appropriate online form available on the "Make a Return" page. Alternatively, they can send the request by email to commerciale@tuxedoitalia.it within 14 days of receiving the package, indicating the order number in the subject line.

Returns must be made exclusively by shipping to the following address:

To be accepted, returned products must meet all of the following conditions:

  • Be intact
  • Not used
  • Be complete with tags, original packaging, and accessories
  • Be in perfect resalable condition

In the event of failure to comply with even one of the above conditions, the seller reserves the right to refuse the return or not proceed with the refund.

Shipping costs for returning the goods are the responsibility of the customer.

In the event of an item or size exchange, for the first exchange per order, the customer is responsible for returning the product, while the seller is responsible for shipping the new product. After the second exchange, it will no longer be possible to exchange the product: the customer must return the product and place a new order.

The refund will be made within 14 days of receipt and inspection of the returned goods, using the same payment method chosen by the customer during the purchase, unless otherwise agreed.

5. Customizations and duties

Customization and Made-to-Measure Production
All products made to the customer's specific request, including personalized or made-to-measure items (e.g., engravings, special colors, oversized items), are excluded from exchanges and returns. Once the customization has been confirmed and production has begun, returns or exchanges are not possible, except for defects in conformity or manufacturing defects covered by the legal warranty.

Duties, Taxes, and Customs Fees
Orders destined for non-EU countries may be subject to customs duties, local taxes, or brokerage fees. These additional costs are not included in the purchase price and are the sole responsibility of the customer. Customers are advised to check with the customs offices in their destination country in advance to learn about any applicable charges.

All prices in our catalog include VAT for customers within the European Union. For non-EU customers, VAT is automatically excluded when viewing the catalog, based on the destination country selected.

Final provisions

These Terms and Conditions are governed by Italian law. Any dispute concerning the interpretation, execution, or validity of these terms and conditions will be subject to the exclusive jurisdiction of the Court of Macerata, except in cases where the Customer, as a consumer, is entitled to bring proceedings before the court of his or her national domicile pursuant to applicable law.
